Services and Website Terms and Conditions
Please read the Terms and Conditions carefully before using the www.adlcallcenter.com website or entering into a Retained Support Agreement (the “Service”) operated by AVail DreamLINK (ADL Call Center) (“us”, “we”, or “our”).
Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use our website or call center services or products.
By accessing or using the Services you agree to be bound by these Terms. If you disagree with any part of the terms then you may choose to not access the Services of ADL Call Center or our website.
Links To Other Web Sites
Our Service may contain links to third-party web sites or services that are not owned or controlled by ADL Call Center.
ADL Call Center has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that ADL Call Center shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
Privacy
Account and account holder information including but not limited to contact and billing information is classified as confidential information and will never be used or shared with any other companies or marketing partners. All accounts protected by ADL Call Center’s non disclosure and non compete policies.
Payments
No refunds at any time for any reason, all sales are final. All Accounts are billed by autopay ONLY a one time set up fee and recurring on a monthly, semi annual, or annual basis by authorized auto payment billed in advance 90 days, for most account types including but not limited to custom and call center accounts (ADL Bot Shop terms may differ). Software only accounts are billed on an annually. Seasonal accounts and compound accounts are billed in advance minimum 90 days for staffing payroll purposes with approval based on risk factors, fair or poor credit accounts may require semi annual or annual auto payment subject to approval. Account early renewal process and billing begins 90 days prior to contract expiration date. Deactivated or Cancelled accounts are not eligible for reactivation or new account. All accounts are processed online or over the phone on a prepaid advance payment basis, by method of visa, MasterCard, American express, Discover or PayPal only, no cash or checks accepted. No post paid accounts, no trial period accounts, no short term account contracts – contract terms options: 1 year, 3 year and 5 years ONLY. Autopay Decline Fee $175 per occurrence.
Termination Early
termination fees will be assed and debited from the card(s) on file, see retained support agreement.
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any verbal mistreatment of staff including without limitation or if contract terms are breached. No refunds, all sales are final.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
Cancellations
Account cancellations of recurring billing requests must be received at office@adlcallcenter.com
a minimum of 120 days prior to the effective cancellation date (6 months for custom, private client, seasonal, and compound accounts).
Governing Law
These Terms shall be governed and construed in accordance with the laws of Colorado, USA, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
